Consent of a parent or guardian is required.

At one time the parent or guardian was not required to be present if a written and notarized statement by the parent or guardian were provided, but the law has been amended recently to require the presence of the parent or guardian. Be sure to check the pocket part to see the most current form of the law.

KRS § 161.790 (2004) governs teachers’ tenure. (Subsection 1(b) mentions “Immoral character or conduct unbecoming a teacher.”)

In the “Notes to Decisions” following the statute, under the heading of “Misconduct,” there is a case involving a teacher who was discharged for smoking marijuana with two students at a party. Even though the behavior did not occur in a teaching situation, the court determined this to be a proper decision because the behavior involved students and therefore had a
connection with the teacher’s occupation.
